The applicant is arrested in Crime 39/2018 registered at Durgapur Police Station, District Chandrapur for offence punishable under sections 376, 376(1)(2)(N), 506 of the Indian Penal Code and section 66(E), 67, 67(A) of the Information Technology Act and is in custody 01.02.2018.

The submission of the learned counsel Shri R.M. Daga is that the applicant, who is a student of engineering with no criminal antecedent is falsely implicated and the relationship is obviously consensual.

Prima face, the submission is well merited. A consensual relationship having gone sour appears to be a real possibility, at least at this stage.

In the light of the accusation and the material on record, I am inclined to allow the application. The applicant be released on furnishing personal

The applicant shall not tamper with the evidence nor shall applicant directly or indirectly attempt to influence the witnesses in any manner.

The application is disposed of accordingly.
