These applications are disposed of by common order as all the applicants in these three applications are seeking pre-arrest bail, apprehending arrest in connection with crime registered against them for the offences punishable under Sections 143, 342, 394, 323, 506, 364-A and 365 of the Indian Penal Code. The crime is registered on the complaint lodged by Gajanan Laxman Gadewar-son-inlaw of Santosh Madhav Marewar (applicant in ABA No.340/2017).
According to the complainant, because of some dispute raised by the applicant regarding not sending the complainant's wife back to the matrimonial house, the accused abducted him and committed the offence as reported.
2 aba293.17+2 The applicants claim to be agriculturists and have stated that they are not involved in any other crime/ offence. Four applicants in Criminal Application (ABA) No. 293 of 2017 are granted protection by this Court by the order passed on 4th May, 2017 with condition that they shall attend Police Station as and when required and shall co-operate with the Investigating Agency. The Investigating Agency has not complained that these four applicants have not co-operated with it.
Considering the facts of the case and the nature of the accusations against the applicants, following order is passed:
In the event of arrest in connection with Crime No. 191/2017, registered by the non-applicant, the applicants be released on bail on executing P.R. Bond for Rs.Twenty Five Thousand each and furnishing one solvent surety in the like amount for each of the applicant.
