2) By the impugned order, the Original Application filed by the Petitioners has been dismissed by the Central Administrative Tribunal primarily on the ground that the Petitioners have not joined the affected persons as party Respondents. 3) Shri Burde, learned Counsel for the Petitioners, submits that the Petitioners were ready and willing to join the persons adversely affected to
the Original Application, however, due to some miscommunication and misunderstanding, such stand could not be taken before the Tribunal.
4) We have perused the impugned order. The conclusion of the Tribunal is primarily based on the position that the Petitioners have refused to join the affected persons as party Respondents. Now since the Petitioners have realised that the stand taken by them was incorrect, we are of the prima facie opinion that the Tribunal may consider their stand, if they choose to file any Review Application. With these observations, we accept the prayer of the Petitioners to withdraw the petition to file a Review Application before the Tribunal. The Writ Petition is accordingly disposed of.
