Non-applicant, who is the wife of applicant no.1, has filed the application under the provisions of Domestic Violence Act before the learned Judicial Magistrate First Class, Pusad against the applicant no.1 and other family members.

The applicants have filed this application under Section 528 of the Bhartiya Nagarik Suraksha Sanhita 2023, before this Court for quashing of the said Domestic Violence proceedings. During the pendency of the present application, the matter has been settled SKNair

60-apl-496-25.odt between the parties. The parties have decided to take divorce by way of mutual consent.

Both the parties have signed the consent terms and agreed the terms and conditions mentioned in the consent terms.

Today, both the parties are present before this Court and they have been identified by their respective counsels.

Non-applicant appeared before this Court and stated that the matter is settled between the parties and she do not want to proceed further and consented to quash the Domestic Violence proceeding.

Considering the joint pursis filed before this Court, the Domestic Violence proceedings pending before the 3rd Joint Civil Judge, Junior Division and Judicial Magistrate First Class, Pusad is hereby quashed and set aside.

Accordingly, the application stands disposed of.
