This appeal is directed against the order dated 14.3.2019 rendered by the learned Special Judge, Akola whereby the application of the appellant - accused for bail is rejected. The offence punishable is under the provisions of section 354 of the Indian Penal Code read with section 7,8, and 9(m) of the Protection of Children from Sexual Offences Act (POCSO Act) and section 3(1)(w)(i)(ii) and 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

By order dated 3.5.2019, the appellant - accused is released on temporary bail.

There is no dispute that the investigation is complete and the chargesheet is filed.

Considering the nature of accusation and the gravity of offence alleged, there is no reason why the accused should languish in jail. The order of temporary bail dated 3.5.2019 is confirmed subject to the modification that the appellant - accused shall attend the office of the Sub-Divisional Police Officer, Akola as and when summoned.
