The applicants are arrested on 2nd April, 2017 in crime registered against them for the offences punishable under Sections 65(a), 83 and 98 of the Maharashtra Prohibition Act on the accusations that though sale of liquor is prohibited in Gadchiroli district, a huge quantity of liquor worth Rs.25,82,400/- is seized from the house of the applicant No.3 and liquor worth Rs.3,57,800/- is seized from the house of the applicant No.2 and during interrogation, it is revealed that the liquor belongs to applicant No.1 and his two brothers Manoj Mujumdar and Krishna Mujumdar. According to the Investigating Agency, the vehicles Mahindra Scorpio and Mahindra Bolero, used in commission of crime are also seized from possession of the applicant No.1.

The applicants have filed affidavit stating that they are not involved in any other crime/ offence. The

2 ba435.17 learned advocate for the applicants has stated that the investigation is complete and charge-sheet is filed on 31st May, 2017.

Considering the facts of the case and nature of accusations against the applicants, following order is passed: The applicants having been arrested in crime registered by the non-applicant vide F.I.R. No.5 of 2017, applicant No.1 Gopal Jagdish Mujumdar be released on bail on furnishing cash security of Rs.One Lakh and one solvent surety in the like amount, applicant No.2-Kiran Somaji Dugga and applicant No.3- Raiji Birja Dumma be released on bail on furnishing cash security of Rs.Fifty Thousand each and one solvent surety in the like amount for each of the applicant. The application is allowed in the above terms. CRI. APPLN.(APPP.) NO. 792/2017 In view of disposal of the bail application, the application praying for time to file F.I.R.. does not survive, hence, it is disposed of.
