M/S Jai Jalaram Infrastructure Thr. Its Partner, Sharad S/O Rajnikant Kathrani, Gondia And Others v. Shri Harshwardhan S/O Balkrishna Bhadupotey And Others

CAC NO. 26 OF 2021 IN CRA NO. 30/2020 Coram : Registrar(Judicial) Dated : 21.09.2021 This application is filed under Order V Rule 20 of the Code of Civil Procedure, 1908, for substituted service upon respondent nos.5 & 10 by paper publication. It is stated in the application that the notice issued to the aforesaid respondents returned back unserved for want of correct address. It is further stated that the service in usual course is not effected. The applicant thus prays for substituted service upon aforesaid respondents.

Considering the reasons mentioned in the application and the bailiff report, the applicant is allowed to serve aforesaid respondents by substituted service on last known address by paper publication.

Substituted service be effected upon aforesaid respondent nos. 5 & 10 by publishing a notice in widely circulated local daily newspaper at Gondia Edition where the aforesaid respondents are lastly known to have resided, in terms of Order V Rule 20 (1-A) of CPC, returnable within four weeks from the date of publication of notice.
