The applicant is arrested on 9th January, 2017 in crime registered against him for the offence punishable under Section 302 of the Indian Penal Code on the accusations that the applicant, suspecting character of his wife has killed her. The crime is registered on the complaint lodged by Manoj Naresh Bhati (brother of the applicant). The complainant has stated that on 9th January, 2017 at about 7.00 a.m. he received a call from his brother which call was made from Sim No.7218418161 and the applicant had told the complainant that he has killed his wife.

The learned advocate for the applicant has argued that charge-sheet does not show that Sim No.7218418161 belongs to the applicant. It is further submitted that the investigation is complete, charge-sheet is filed and the custody of the applicant is not required for further investigation.

2 ba436.17 Considering the facts of the case, following order is passed:

The applicant having been arrested in Crime No.10/2017, registered by the non-applicant, he be released on bail on executing P.R. Bond for Rs.Twenty Five Thousand and furnishing two solvent sureties in the like amount. The application is allowed accordingly.

CRI. APPLN.(APPP.) NO. 794/2017 In view of disposal of the bail application, the application praying for time to file charge-sheet does not survive, hence, it is disposed of.
