It is submitted by the learned Counsel for the petitioner that the direction under Section 79(1) of the Maharashtra Cooperative Societies Act, 1960 has been issued pursuant to the communication dated 14/02/2023 based on the directions issued by the Hon'ble Minister. It is urged that the provisions of Section 79 of the said Act are not attracted and action, if any, is to be taken under Section 83 of the said Act. Notice dated 24/04/2023 grants an opportunity to the petitioner to place on record the relevant documents. According to the learned Counsel for the petitioner, all necessary record has been placed before the said authority on 19/04/2023.

02] Since, we find that at this stage there is only a notice issued to the petitioner to furnish the relevant documents, which according to the petitioner has been complied, we do not find any reason to interfere at this stage. By observing that, if any, adverse action is taken against the petitioner, the same shall not be acted upon for a period of two weeks, the writ petition is disposed of with no order as to costs.
