DATED : OCTOBER 9, 2018 Heard Mr. Ahmad, learned counsel for applicant and Mr. Ali, learned counsel for non applicant. The present application is filed by the applicant/wife for transferring Hindu Marriage Petition No.19/2017 pending on the file of Civil Judge Senior Division, Gondia to the Court of Civil Judge Senior Division, Chandrapur. This Court had on 05.09.2018 ordered for medication in between the parties, looking to the fact that the dispute was matrimonial one. With the assistance of the learned Mediator, the parties have arrived at an amicable settlement and mediation has resulted into success. Before the learned Mediator, terms of compromise are also settled. One of the terms in the agreement was that Hindu Marriage Petition filed by the non applicant for divorce shall be converted into the petition for mutual divorce. However, in view of the stay, the said is not proceeding further.

cao1802.18.odt The present application is therefore filed for disposal of Misc. Civil Application No. 485/2017. Since the matter is amicably settled in terms of the compromise arrived at in presence of the learned Mediator, the present application is disposed of. Ad interim stay granted in this application stands vacated and it shall be open for both; applicant and non applicant to perform their part as they agreed in the agreement.

The present application as well as Misc. Civil Application No.485/2017 stand disposed of.
