Heard Shri Patil, learned counsel for the applicant and Shri Chutke, learned APP for the nonapplicant - State. Vide order dated 09.06.2020, the present applicant is protected by way of interim bail. A perusal of the affidavit-in-reply filed on behalf of the State shows that he was holding a gun (Katta) and the co-accused Indersingh snatched that Katta from him and as such the present applicant did not use any weapon nor inflicted any serious injury. Admittedly, there was no gun shot injury to the informant.
The learned APP appearing on behalf of the State could not point out from affidavit-in-reply any justifiable ground for custodial interrogation of
2407aba294.20 the present applicant or any criminal antecedents against him.
On the contrary, it is stated by the learned counsel for the applicant that there are 3 - 4 criminal cases registered against the complainant/ informant. Considering the role attributed to the present applicant, I am inclined to allow the present application.
In the circumstances, the interim protection granted to the present applicant vide order dated 09.06.2020 is hereby confirmed on the same terms and conditions.
This order be communicated to the counsel appearing for the parties, either on the email address or on Whats app or by such other mode, as is permissible in law.
