The respondent accused is acquitted of an offence punishable under section 138 of the Negotiable Instruments Act. The basis for acquittal is that the cheque which was dishonoured was for a recovery of time barred debt. In my opinion, looking to the provisions of Section 138 and 140 of the Negotiable Instruments Act, the case for grant of leave is made out. Hence, leave granted. Criminal Appeal ______/2016.
