By this application, the applicant is seeking recalling of order dated 08.04.2024 by which, the learned trial Court was directed to dispose of the trial within three months.

He submitted that now the Hon'ble Apex Court has released one accused on bail on the basis of said other accused are also released on bail. He also invited my attention towards the observation of the Magistrate wherein he has mentioned that the evidence of chief-examination of all the witnesses are recorded, however cross-examination is to be carried out and considering the chief-examination which is lengthy running near about 100 pages, the sufficient time is required for the cross-examination of each witness.

Considering the fact that now the accused are released on bail, the requirement of expedition

(2) 943.appp.793.2024 of trial is not in existence, in view of that, the order dated 08.04.2024 is recalled.

The application is disposed of.
