Heard learned counsel for the rival parties. Perused the FIR as well as the impugned order. It appears that though the applicants have participated in the assault that was made on the victim, the head injury was caused by Pravin Kange by iron rod. Pravin Kange and two others have already been released on bail.

That being so, I make the following order.

ORDER

(i) Criminal Application No.287/2015 is allowed.

(ii) In the event of arrest in Crime No.150/2015 registered with Police Station Arni for an offence punishable under Section 147, 148, 149, 307, 504 and 506 of the Indian penal Code, applicant no.1-Balwant s/o Motiram Gawande, applicant no.2-Chandan s/o Manoj Saoyam, applicant no.3-Rupesh s/o Deorao Meshram and applicant no.4-Lakhan s/o Anil Aswar shall be released on

aba287.15 bail on their executing PR Bond in the sum of Rs.20,000/- each with one surety each in the like amount. (iii) The applicant shall attend Police Station Arni, Dist. Yavatmal on every Sunday between 10.00 am and 04.00 p.m. and shall cooperate with the Investigating Officer during investigation.

(iv) The applicant shall not tamper with the prosecution evidence and shall not influence the witnesses.
