IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH : NAGPUR WRIT PETITION NO. 3259 OF 2015 Shri Sukhdeo Sitaram Tayde .vs. Dr. Punjabrao Deshmukh Krishi Vidyapeeth, Akola Office Notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's orders or directions and Registrar's orders.

Mr. N.S. Warulkar, Advocate for petitioner, Mr. U.J. Deshpande, Advocate for respondent.

CORAM : B.R. GAVAI & INDIRA K. JAIN, JJ.

DATED : JULY 31, 2015.

The petitioner challenges the impugned transfer from Akola (Wanirambhapur) to Sindevahi. It is the contention of the learned Counsel for the petitioner that no reasons are given while transferring the petitioner.

It is to be seen that though the petitioner was physically posted from 2013 to Wanirambhapur, he is attached to headquarters at Akola right from 2010. The impugned transfer order is after a period of 5 years. It thus cannot be said that it is a premature order, apart from the fact that the order is passed in the month of May and it is not a mid-term transfer. As such, no reasons are necessary to be recorded. In so far as the medical ground of the petitioner is concerned, the only reason is that the petitioner on account of suffering from Colitis cannot have water and food from outside.

31.7WP.3259.15 The petitioner can very well arrange to buy a waterfilter which is available in plenty even at Taluka places like Sindevahi.

The Writ Petition is hence rejected.
