The petitioner is the Peon, working in the private aided School run by the Minority Institution which was subsequently closed, has challenged the acceptance of notice of voluntary retirement. 3.

The case of the petitioner is covered by the expression "otherwise termination" under Section 9 of the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Act, 1977 and Rules, 1981. Hence, the petitioner has a statutory remedy to file an appeal before the School Tribunal. All questions are left open.

Petition is dismissed.
