Shri Bhushan Mohata, the learned counsel for the appellantDepartment, states on the basis of instructions received from the Assistant Commissioner of Income Tax, Circle-3, Nagpur vide communication, dated 21.07.2016 that the Department would not proceed with the said Income Tax Appeal, as the tax effect involved in the appeal is only Rs.14,39,368/-, that is below Rs.20,00,000/-. It is stated that in view of the aforesaid, the Department may be permitted to withdraw the appeal.

On the motion made by the learned counsel, the Income Tax Appeal stands disposed of as withdrawn.
