Heard Mr.S.G.Karmarkar, learned Counsel for the applicant and Mr.T.A.Mirza, learned Additional Public Prosecutor for nonapplicant/State. The hearing was conducted through Video Conferencing and the learned Counsel for the respective parties agreed that the audio and visual quality was proper.
Mr.T.A.Mirza, learned Additional Public Prosecutor for non-applicant/State has pointed out Section 14-A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and submitted that, in view of Judgment of Apex Court in the case of Prathvi Raj Chauhan vs. Union of India and Others, Writ Petition ( C) No.1015 of 2018, dt.10.2.2020, this Court has power to grant anticipatory bail. From the perusal of F.I.R. lodged against the applicant, it appears that the offences punishable under Sections 354(A)(1)(i)(ii), 417 and 500 of the Indian Penal Code r/w. Section 67 of the Information and Technology Act r/w. Section 3(1)
2 ldvc781.20 (W)(i)(ii) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act are registered against the applicant.
Mr.S.G.Karmarkar, learned Counsel for the applicant submits that he will file appeal as provided under Section 14-A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act within a period of one week.
Looking to the allegations in the report, ad interim anticipatory bail is granted to the applicant for a period of one week.
In the event of arrest, the applicant be released in Crime No.15 of 2020 registered by Police Station Deolapur on execution of P.R. bond in the sum of Rs.25,000/- with one solvent surety in the like amount.
The applicant shall cooperate with the Investigating agency.
He shall remain present in Police Station, Deolapur as and when called by the police.
The application is disposed of.
The applicant is at liberty to file appeal as provided under Section 14-A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
This order be communicated to the Counsel appearing for the parties, either on the email address or on WhatsApp or by such other mode, as is permissible in law.
