DATED : 04 FEBRUARY 2021 Civil Application is filed for amendment of the writ petition to challenge the order dated 19 October 2020 whereby the extension to the elected body of the Petitioner - APMC has been refused. The Petition was filed by the Petitioner with a grievance that no decision is taken about continuation of the elected body of the Petitioners while extension has been granted to others.

The Petition as filed does not disclose as to how it is using discrimination resulted in discrimination. Now, an order has been specifically passed refusing extension to the Petitioner. The challenge to such an order would stand at a different footing.

The learned Counsel for the Petitioner states that the challenge made in the amendment application is only a continuation of the cause. According to us, the amendment application challenges a different order and should be appropriately challenged in a substantive Petition. In case the Petitioner is interested in challenging the order dated 19 October 2020, all legal and factual grounds are kept open. 4.
The Writ Petition and amendment applications are accordingly disposed of with liberty as above.
