Heard learned Counsel Shri Kariya for the applicant and Shri Dubey, learend APP for the respondent/State. 3.
Complainant-Circle Officer lodged report stating that after receipt of the information, they stopped the truck bearing no. MH-34-M-3631. Driver of the truck was not ready to take the truck to Police Station. Driver of the truck called the owner of the truck. After arrival of the applicant they unloaded the sand and run away. Custodial interrogation for recovery of the sand is not required. Hence, application is allowed. In view of the above, anticipatory bail is granted on the following conditions: (i) In the event of arrest of applicant - Umesh S/o Dulichand Poddar in Crime No. 535/2020 registered with Police Station, Wani, Dist. Yavatmal, he be released on his executing a P.R. Bond in the
LD-VC-ABA 360.2020.odt sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with one solvent surety of like amount. (ii) He shall attend the Police Station, Wani, Dist. Yavatmal once in a week i.e. on every Sunday in between 10.00 a.m. to 05.00 p.m. and shall cooperate the investigating agency. 4.
Accordingly, the application is disposed of.
