Heard learned counsel Shri M.V. Bute for the petitioner and learned Assistant Government Pleader Shri M.K. Pathan for the respondents 1 to 5. 2.
Owing to the petitioner's failure to produce the validation of his caste status, the petitioner's employer (the State Government) has terminated his service. Such termination was challenged by the petitioner before the Maharashtra Administrative Tribunal, Nagpur Bench, Nagpur by instituting Original Application No.141 of 2011. The tribunal by its order dated 25.4.2017 has dismissed such application on merits. This order is the subject-matter of challenge in this writ petition. 3.
After hearing progressed to some length, Shri Bute seeks leave to withdraw the writ petition. He also seeks liberty on behalf of the petitioner to approach the appropriate authority / tribunal, as the case may be, in accordance with law after obtaining the validation of his caste status from the Caste Scrutiny Committee.

In view thereof, the writ petition stands dismissed as withdrawn with liberty to the petitioner as prayed for by Shri Bute. (AMIT B. BORKAR, J.) (CHIEF JUSTICE) !! BRW !!
