The applicant (aged about 65 years) having been arrested in connection with Crime No. 101/2018 for the offences punishable under Sections 304 and 34 of the Indian Penal Code, seeks direction to the non-applicant to release him on bail.

According to the Investigating Agency, Deorao Suraskar (deceased), had gone near the house of the applicant for nature's call and noticing this, the applicant and his son assaulted Deorao Suraskar and gave fist blows. The incident is of 04/04/2018. Deorao Suraskar was hospitalized on 05/04/2018 and he died on 06/04/2018. The applicant is arrested on 06/04/2018.

Considering the facts of the case, nature of accusations, age of the applicant, fact that the applicant is not involved in any other crime/offence and as the non-applicant has not been able to show that the custody of the applicant is required for further investigation, the following order is

2 ba464.2018 passed:- The applicant having been arrested in connection with Crime No. 101/2018, be released on bail, on furnishing P.R. Bond for Rs. 25,000/- (Rs. Twenty Five Thousand) and one solvent surety in the like amount.

The applicant shall attend the Sessions trial on every date unless granted exemption by the Sessions Court. The application is allowed in the above terms. JUDGE Ansari
