DATED : 05-01-2021 The applicant is apprehending arrest in Crime 82/2020 registered with Palandur Police Station, District-Bhandara for offences punishable under Sections 420, 468 and 471 read with Section 34 of the Indian Penal Code.

The applicant was the Headmaster of the Govind High School and Junior College, Palandur at the relevant time. The submission is that the report is lodged in view of the rivalry between two groups in the society which manages the said institution. It is further submitted that on a holistic consideration of the material, prima facie case of misappropriation of fund is not made out. 3.

The applicant was granted interim protection vide order dated 28-8-2020. It is not the case of the prosecution that the applicant has misused the liberty. 4.

Rode, on instructions from the Investigating Officer who was personally present when this application was heard for sometime on 04-1-2021, that custodial interrogation is not necessary and it would suffice if the applicant attends the police station and is available for further interrogation, if the Investigating Officer so deems fit. 5.

The interim protection granted vide order dated 28-8-2020 is made absolute with the only modification that the applicant shall attend the Economic Office Wing, Buldhana, till the filing of the charge-sheet, on every Monday and Friday from 11-00 a.m. to 2-00 p.m. and shall cooperate with the Investigating Officer.
