This Court on 8th May 2014 after noting contention of petitioner-Institution that its name was wrongly included in list of 250 banned colleges and because of realization of that error, its students were permitted to appear in 1st semester examination, adjourned the matter to 20th June 2014. Request to permit those students to appear for 2nd semester examination then to commence shortly provisionally was not granted. It is not in dispute that thereafter the Nagpur University conducted special examination in the month of August 2014 and those students appeared for 2nd semester examination in that month.

These writ petitions were then considered by this Court on 4th December 2014 and considering subsequent development, students who took 2nd semester special examination were permitted to appear in 3rd semester examination (regular).

Writ Petition No. 2448 of 2013 and other connected petitions in which the question of ban or inclusion of names of colleges in list of 250 colleges was in dispute, came up before the Division Bench of this Court on 8th December 2014. The Division Bench on that date has considered CAW No. 3685 of 2014 moved in WP No. 2448 of 2013 by the Nagpur University. Application was granted and result of special examination was allowed to be declared. 4.

In this situation, it is apparent that present grievance is rendered infructuous. However, results of students of petitioner-Institution who had cleared 2nd semester examination or who were otherwise eligible to appear for 3rd semester examination shall be declared by the University in accordance with law at the earliest.

With this direction, both these writ petitions are partly allowed and disposed of. No costs. JUDGE JUDGE joshi
