The applicant is in custody since 04.04.2018 in connection with Crime 382/2012 registered at the Police Station Sadar, Nagpur for the offence punishable under sections 403, 406, 465, 468, 471, 420, 467 and 109 read with section 34, 120-B of the Indian Penal Code. The accusation against the present applicant is that he was the Sales Executive, who assisted several borrowers to obtain loan from UCO Bank with the help of forged or fabricated documents.

The order of learned Single Judge of this court (S.B. Shukre, J.) dated 26.04.2018 in Criminal Application (BA) 372/2018 is brought to my notice. While granting bail to the Branch Manager, the learned Single Judge noted that although the crime was registered in December 2012, the applicant was arrested in March 2018. It is further noted by the learned Single Judge that the borrowers are consistently released on anticipatory bail between 2013 to 2016.

ba465.18.O.odt 2 Even if the prosecution case is taken at face value, the role of the present applicant cannot be more serious or graver than that of the borrowers. Be that as it may, I do not see any reason why the applicant should languish in jail.

The application is allowed.

The applicant be released on bail on his furnishing a personal bond of Rs.15,000/- with a solvent surety of the like amount.

The applicant shall attend the dates of hearing scrupulously.
