CORAM : MANISH PITALE J DATED : 15.11.2019 These writ petitions are filed against order passed by the Court of Adhoc District Judge, Nagpur whereby appeal filed by the petitioners in writ petition No.3995/2016 was partly allowed and order of temporary injunction passed on Exh.5 by the Trial Court was modified 2.

At the outset when the writ petition was called for hearing, the learned senior counsel appearing for the petitioner in writ petition No. 3995/2016

2 / 2 wp3995 & 3280.16 submitted that present writ petition may be disposed of by an appropriate direction to the Trial Court to decide the suit itself in a time bound manner expeditiously. 3.

The learned counsel appearing for the contesting respondent has no objection to the said submission.

In view of the above, the writ petitions are disposed of with a direction that the Court of Small Causes, Nagpur shall dispose of Regular Civil Suit No.55/2015, as expeditiously as possible, but in any case within a period of four months from today.

It is made clear that this Court has not made any observation as regards merits of the dispute between the parties and the Court of Small Causes, Nagpur is directed to decide the suit without being influenced by the observations made by the Appellate Court in the impugned order.
