This is an appeal under Section 14(A) of the The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. On 28/07/2021, interim order was granted in favour of the appellant.

Today, when the matter was called out, learned counsel for the appellant submits that during pendency of the appeal, the Investigating Officer has filed charge-sheet before the trial Court. In that view of the matter, he wishes to withdraw the present appeal in order to file the application afresh before the Trial Court in the light of filing of charge-sheet.

His statement is accepted.

The appeal is disposed of as withdrawn with liberty to the appellant to file application for pre-arrest

The learned counsel for the appellant submits that on or before 16/12/2021, he will be filing the fresh application.

His statement is accepted.

If the application for pre-arrest bail is filed afresh on or before 16/12/2021, the interim order granted by this Court on 28/07/2021 shall remain continued till 28/12/2021. The learned Court before whom the application will be filed shall decide the same on or before 28/12/2021 in accordance with law. 8.

The appeal is disposed of.
