The petitioner preferred petition for annulment of marriage under Section 12 (C) of the Hindu Marriage Act, 1955 which is pending.

The petitioner preferred an application Exh.53 seeking a direction to the respondent - wife to give the sample of the child for DNA profiling test. The petitioner evidently denied the paternity. This application was rejected by the trial court vide the order impugned.

This Court directed the DNA test in view of the willingness expressed by the petitioner to bear the expenses thereof.

The DNA report is received which confirms the petitioner and the respondent to be the biological parents of the child.

Nothing survives in the petition, which is accordingly disposed of.
