Heard learned Advocate Shri Jagirdar for the applicants and Mrs. Jachak, learned Additional Public Prosecutor for the State.

Perused the order passed by the Sessions Judge, Akola. From the perusal of report and order, it appears that accused are involved in crime punishable under Section 326 read with Section 34 of the Indian Penal Code. The applicants beat the injured by iron pipes. The injured was admitted in the hospital and he was under treatment. It appears from the order passed by Sessions Judge that custody of the applicants is required. There is nothing on record to show that weapons used in the crime are recovered by police. Therefore, custodial interrogation of the applicants is required. In that view of

LD-VC-ABA 567.2020.odt the matter, the application is rejected.
