It would not be necessary to issue notice to the respondent nos.3 and 4 on this civil application as the respondent nos.3 and 4 were not represented by counsel on 12.10.2015 when this writ petition was dismissed for want of prosecution.
We have heard the learned counsel for the applicant and the learned Assistant Government Pleader for the respondent nos.1 and 2.
For the reasons stated in the civil application, the delay in filing the restoration application is condoned. The civil application is allowed and disposed of.
M.C.A. ST. NO.10552/2016 It would not be necessary to issue notice to the respondent nos.3 and 4 on this miscellaneous civil application as the respondent nos.3 and 4 were not represented by counsel on 12.10.2015 when this writ petition was dismissed for want of prosecution.
2 cao1197.16.odt For the reasons stated in the miscellaneous civil application, the writ petition is restored to file, subject to payment of costs of Rs.750/- to the Vidarbha Lady Lawyers' Association within one week.
The miscellaneous civil application is allowed in the aforesaid terms and disposed of.
If the costs are paid and the writ petition is restored, issue notice to the respondents for hearing of the writ petition on merit.
