CORAM : PUSHPA V. GANEDIWALA, J.
JUNE 22, 2020.
Heard through Video Conferencing with clarity in communications.
The applicant - Raheman s/o Nura Nandawale apprehends his arrest in Crime No.
457/2019 for the offence punishable under Section 302 read with Section 34 of the Indian Penal Code registered at police station Karanja, Tah. Karanja, District Washim.
The allegations against the present applicant is that he along with co-accused forcibly administered poison to the deceased. The accused in this crime are the relatives of wife of the deceased. Shri Dhobale, learned Counsel for the applicant urged to release the applicant on pre-arrest
LDVC-23-ABA295.2020 bail on the ground of parity as other co-accused have already been released on bail by the Sessions Court. A perusal of the First Information Report would reflect the major role played by the present applicant. He is stated to have administered poison to the deceased who ultimately died.
Considering the role played by the present applicant, though the charge-sheet is filed I am not inclined to grant him pre-arrest bail. Hence the application is rejected.
This order be communicated to the counsel appearing for the parties, either on the e-mail address or on Whats app or by such other mode, as is permissible in law.
