By this writ petition, the petitioner challenges the order dated 20/04/2011 passed by the Regional Manager of the Maharashtra State Road Transport Corporation directing recovery of an amount of Rs.2,00,000/- from the petitioner. It is submitted by Shri C. V. Jagdale, the learned counsel for the petitioner that against aforesaid order, the petitioner has filed an appeal before the respondent No.1 and the same is still pending. It is submitted that appropriate directions be issued for deciding the said appeal expeditiously.

Shri V. G. Wankhede, the learned counsel for the respondents, submits that in case said appeal is not yet decided, the same shall be decided within a reasonable period. Considering the fact that the petitioner has filed an appeal against the order dated 20/04/2011 before the respondent No.1, we direct that if the said appeal has not yet been decided, the same shall be decided within a period of four months from today. We make it clear that we have not examined the question as regards maintainability of the said appeal.

In view of above, writ petition is disposed of. No costs. JUDGE JUDGE KHUNTE
