It is common ground that the matter has been settled between the parties. Learned counsel for respondent submits that the decree has been satisfied in terms of settlement before the learned Mediator. The agreement regarding settlement of dispute has been filed on record. Therefore, the appeal is disposed of on the terms and conditions mentioned in settlement agreement and decree be drawn accordingly. CIVIL APPLICATION (S) NO.813 OF 2023 3.

In wake of the settlement between the parties, the respondent is permitted to withdraw the amount of Rs.9,50,804/- deposited by the appellants before this Court alongwith accrued interest, if any. Therefore, the respondent is permitted to withdraw the aforesaid amount alongwith accrued interest, if any.
