Heard.

The applicant is arrested on 21st January, 2017 in crime registered by the non-applicant for the offence punishable under Sections 65(a)(e) and 83 of the Maharashtra Prohibition Act.

The crime is registered against the applicant and two others. According to the investigating agency, though sale of liquor in Chandrapur district is prohibited, the co-accused were transporting liquor for sale in Chandrapur district in the vehicle "Bolero" and the applicant was travelling in vehicle "Scorpio" guiding the co-accused informing them whether road is free of police patrolling or not. According to the investigating agency, liquor worth Rs.4,60,000/- is seized.

The investigation is complete and charge-sheet is filed on 6th March, 2017. Co-accused

2 ba444.17 Tulsidas, Rahul Golait and Rahul Dongarwar are released on bail as per the orders passed by this Court. The non-applicant has not been able to show that the custody of the applicant is required for the further investigation. In the facts of the case, the following order is passed:

The applicant having been arrested in Crime No.50/2017 registered by the non-applicant, he be released on bail on furnishing cash security of Rs.1,00,000/- (Rs. One Lakh) and one solvent surety in the like amount.
