The complaint filed by the applicant under Section 138 of Negotiable Instruments Act has been dismissed by acquitting the accused, on the ground that though the cheque has been issued by him however, the accused had lodged complaint earlier in point of time disputing the validity of the accounts, considering which, a case for leave is made out.

Leave is accordingly, granted.
