None for the petitioner.

List in the week commencing from 22/09/2025.

The petitioner may avail remedy under Rule 16 of the Maharashtra Prisons (Furlough and Parole) Rules, 2024. Also the petitioner's Counsel shall take instructions and make submissions."

2) Learned counsel for the petitioner submits that the petitioner is not being allowed to file an appeal. 3) We find that the petitioner was pursuing remedy before this Court and therefore, if he intent to file an appeal, the benefit under Section 14 of the Limitation Act,1963 should be extended to him.

4) In any case if the petitioner is desirous of filing an appeal, he shall file the same within two weeks from today. If the KOLHE

2 70-cr.wp 374.2025.odt appeal is so filed, the respondent shall entertain the same and decide it in accordance with Maharashtra Prisons (Furlough and Parole) Rules, 2024 i.e. decision shall be taken within one month from the date of filing of an appeal.

5) With the aforesaid observations and liberty, the petition is disposed of.
