The learned counsel for the respondents raises a preliminary objection to the tenability of the petition on the ground that the petitioner has an alternate remedy under the provisions of Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002.

By upholding the preliminary objection raised on behalf of the respondents, we decline to entertain the Writ Petition. The Writ Petition is disposed of. The points raised in the petition are kept open. JUDGE JUDGE sahare
