DATED : 19th JUNE, 2024 This petition takes exception to the order dated 30.04.2024 passed by the learned District Judge, Nagpur below Exh.9 in R.C.A. No. 118/2024.

I have heard the learned Senior Counsel for the parties.

Considering the overall facts and circumstances of the case, the following order is passed.

i.

The learned District Judge shall decide R.C.A. No.118/2024 as early as possible and in any case within ten weeks from the date of receipt of the copy of this order.

The interim order passed by this Court dated 15.05.2024 shall remain in force till the decision of the appeal.

iii.

Needless to mention that the learned District Judge shall decide the appeal on its own merits without being influenced by the order passed by this Court dated 15.05.2024.

iv.

The petition is disposed of in the above terms. No costs.
