By this application under Section 438 of the Code of Criminal Procedure the applicant/ accused, aged about 25 years, seeks pre-arrest bail apprehending arrest in connection with Crime No.534 of 2019 registered against him for the offences punishable under Sections 354-D, 324, 504, 506 and 34 of the Indian Penal Code.

According to the prosecution, the applicant used to misbehave with the daughter of the complainant, she being aged about 14 years, and when the complainant was told to refrain himself from such misconduct, on 6th December 2019 the applicant along with other persons assaulted Akshay Galphade (cousin of the complainant) and Akshay Galphade suffered injury on his thigh. The facts on record show that there is counter complaint against the complainant. Considering the facts of the case and pandemic situation, I am of the view that the applicant is entitled for protection.

2 LD-VC-ABA19.20 Hence, the following order :

In the event of arrest in connection with Crime No.534 of 2019 registered with the Non-applicant Police Station, the applicant be released on bail on executing P.R. Bond for Rupees Twenty Thousand and furnishing cash security of Rupees Ten Thousand.

The applicant shall attend the concerned Police Station on every Wednesday between 10:00 a.m. and 01:00 p.m., till filing of the charge-sheet.

The applicant need not attend the Police Station if the Investigating Agency informs him in writing that he is not required to attend the Police Station.

The Criminal Application is allowed in the above terms.
