KHOBRAGADE, JJ DATED : JANUARY 04, 2023 The grievance of the petitioner is that he is denied retiral benefits including pension on the ground that since he has availed the benefit of protection under the Special Backward Class category, and came to be appointed on a supernumerary post, he is not entitled to retiral benefits.

Our attention is invited by the learned Additional Government Pleader Mrs. K.S. Joshi and learned counsel for the respondents 3 and 4 Mr. D.R. Bhoyar to the recent Government Resolution dated 14.12.2022 which reflects the decision of the State Government to extend retiral benefits to the employees, such as the petitioner. 3.
In view of the Government Resolution dated 14.12.2022, the grievance does not survive.

However, we direct the respondents to ensure that the retiral benefits are released to the petitioner within the next three months. 5.
The Writ Petition is disposed of.
