Heard.

The petitioners declared surplus in 'zero budget', were taken back and, thereafter, have been given deemed date by order dated 6.3.2010. This order is not in dispute and has not been assailed. Deemed date 16.1.1990 is given only for the purpose of counting seniority. The order expressly mentions that excluding benefit of seniority, no other benefits like past arrears, wages and allowances or damages can be claimed by them from said date. Thus, except for seniority, the deemed date has not been awarded and object appears to be not to cast any burden on public exchequer.

In this situation, with liberty to petitioners to take such other steps as are open to them in law, we dispose of present Petitions. No costs.
