The challenge in the writ petition is to the order passed in Miscellaneous Civil Appeal No.55 of 2014 dated 04.04.2016 allowing the miscellaneous appeal filed by the respondent and restraining the present petitioners from entering the suit property and disturbing her possession.

It is submitted by the learned counsel for the parties that the proceedings in Regular Civil Suit Nos.237 of 2011 and 28 of 2014 have been now consolidated and the suits are at the stage of recording evidence. They jointly request that proceedings in both the suits be expedited.

Accordingly, the proceedings in Regular Civil Suit Nos.237 of 2011 and 28 of 2014 that have been consolidated are expedited. The trial Court shall decide the same without being influenced by the observations made in the orders passed in the application for temporary injunction.

The writ petition is accordingly disposed of. No costs. JUDGE APTE
