By this application under Section 438 of the Code of Criminal Procedure the applicant, aged about 28 years, seeks pre-arrest bail apprehending arrest in connection with Crime No. 111 of 2020, registered with the non-applicant Police Station for the offences punishable under Sections 376(2)(n), 420 and 34 of the Indian Penal Code. The First Information Report is registered against the applicant on 14th March 2020 on the complaint lodged by the prosecutrix aged about 26 years. According to the prosecutrix, the applicant and the prosecutrix had an affair since 2018. The applicant claims that he is working as Computer Engineer in a Company at Mumbai. The prosecutrix resides at Narkhed, District : Nagpur and First Information Report is registered at that place.

Considering the facts of the case, nature of the accusations against the applicant and the present situation, I am of the view that the applicant is entitled for protection.

2 LD-VC-ABA90.20 Hence, the following order :

In the event of arrest in connection with Crime No.111 of 2020 registered with the Non-applicant Police Station, the applicant be released on bail on executing P.R. Bond for Rupees Fifty Thousand and furnishing cash security of Rupees Twenty Five Thousand.

The learned Advocate for the applicant, on instructions, states that the applicant would attend the nonapplicant Police Station within 15 days of lifting of the lockdown and undertakes to complete necessary formalities for executing P.R. Bond and depositing cash security and will co-operate with the Investigating Agency.

The Criminal Application is allowed in the above terms.
