Rule. Rule made returnable forthwith and heard the learned counsel for the parties.
The petitioner is serving with Zilla Parishad, Akola as an Assistant Teacher. As the petitioner claims to belong to 'Tadvi' tribe which is recognised as Scheduled Tribe, his tribe certificate was sent to the Scrutiny Committee for verification. It is informed that presently the report of the Vigilance Cell is awaited and after its receipt the Scrutiny Committee would verify the claim as made by the petitioner. Since the petitioner was issued the order dated 28/12/2020 placing him on supernumerary post, the petitioner has approached this Court.

Considering the fact that the claim of the petitioner is pending before the Scrutiny Committee for adjudication, appropriate directions are liable to be issued to the respondent No.2-Scrutiny Committee to complete the process of verification within a period of six months from the first date of appearance of the petitioner. The petitioner shall appear before the Scrutiny Committee on 05/03/2022. Till the claim of the petitioner is adjudicated by the Scrutiny Committee, the employment of the petitioner shall not be disturbed.
With these directions the writ petition is disposed of. Rule accordingly. No costs.
