Applicant is seeking pre-arrest bail in Crime No. 141 of 2022 registered on 18th April, 2022 with Police Station Achalpur, District Amravati for the offence punishable under Sections 143, 147, 148, 149, 186, 353 and 335 of the Indian Penal Code read with Section 135 of Maharashtra Police Act, 1951.

Learned counsel for the applicant submits that except the applicant most of the co-accused persons have been released on bail by the trial Court under Section 439 of the Code of Criminal Procedure. 4.

It is further submitted that applicant has been falsely implicated in the alleged offence. Accordingly, he prays for grant of bail.

On the other hand learned Additional Public Prosecutor strongly opposed the present application.

I have perused the case diary and also contents of the First Information Report.

The First Information Report came to be registered on 18th April, 2022 and the investigation is almost completed. The trial Court has granted bail to most of the co-accused persons involved in the alleged offence. Thus, considering the fact that other accused persons have been released on bail and as the investigation is almost completed, I am of the opinion that the custody of the applicant is not necessary. Accordingly, I pass the following order.

ORDER

i.

Criminal Application is allowed;

ii.
