After having realised that the land in question from which the way is claimed by the petitioner comes within the municipal area, the learned counsel for the petitioner seeks permission to withdraw the petition so as to enable him to avail appropriate alternate remedy. He further prays that the time spent in prosecuting the present writ petition may be taken into consideration while considering the delay caused in approaching the appropriate authority for seeking relief. The writ petition is disposed of as withdrawn with liberty as prayed for. No order as to costs. All the contentions raised by the petitioner are kept open.
