The only prayer made by the petitioner in the instant petition is for a direction to the respondents to pay the arrears of salary to the petitioner from June, 2015 till April, 2016. The petitioner seeks a direction to the respondents to pay the salary of the petitioner regularly.
The petitioner was appointed as Shikshan Sevak in the respondent No.1-School on 24.06.2012. The services of the petitioner were terminated and the petitioner filed an appeal before the School Tribunal challenging the termination order, on 05/06/2015. In the appeal, the School Tribunal passed an order staying the order of termination and permitting the petitioner to discharge his duties. It is the case of the petitioner that though the petitioner is discharging his duties, in view of the order of the School Tribunal, the respondents have not paid the salary to the petitioner.
Since the facts in regard to the termination of the services of the petitioner and the stay granted by the School Tribunal are not disputed, we dispose of this writ petition with a direction to the respondent Nos.1 and 2 to send the salary bills of the petitioner for the period from July, 2015 till June, 2016 to the respondent No.3 within a
2/3 period of fifteen days. We direct the respondent No.3 to pay the arrears of salary to the petitioner within a period of one month from the receipt of the pay bills from the respondent Nos.1 and 2. We direct the respondent Nos.1 and 2 to regularly send the pay bills of the petitioner to the respondent No.3 for the payment of salary. Order accordingly. No costs.
