As the registration of the writ petition was refused for non-removal of the office objections, without issuing notice to the non-applicants / respondents and accepting the reasons stated in the application, the delay of 24 days in filing the Misc.Civil Application is condoned. The Civil Application is allowed.
For the same reasons, as stated above, the order passed by the learned Registrar (Judicial) on 2nd February, 2015 is set aside and the writ petition is restored. The Misc. Civil Application is allowed.
W.P.NO. 90/2015.
If the office objections are not removed within four weeks, the petition shall stand dismissed without reference to the Court, with costs quantified at Rs.One Thousand to be deposited by the petitioner with the High Court Legal Services Sub-Committee, Nagpur.
