Not on Board. Taken on Board at the request of the learned Assistant Government Pleader for the applicant/ respondent no.1. It is stated by the learned Assistant Government Pleader that Shri P.S. Patil, the learned counsel for the original petitioners has been informed that the matter would be taken on Board today.
We find from our order dated 5th December,2017 that merely because the applicant has not filed the reply, a bailable warrant was issued against the concerned respondent/ (present applicant). The concerned respondent was also directed to deposit an amount of Rs.21,000/- with the Registry of this court to show the bona fides. It appears that the said order was not passed in view of any liability on the part of the applicant to pay any amount to the original petitioners but the order appears to have been passed due to the default on the part of the present
applicant, to put in appearance through a counsel on that day and to file reply.
In view of the aforesaid, we grant the prayer made in the Application and permit the applicant to withdraw the sum of Rs.21,000/- deposited in this Court.
The Civil Application stands disposed of accordingly. JUDGE JUDGE sahare
