Heard learned counsel for the applicant and learned APP for the respondent/State.

The allegation is that when the vehicle was intercepted by the police, two persons jumped out of the vehicle and vanished in thin air and this applicant is one of them. However, there is no material available on record on the basis of which it could be prima facie said that the applicant was one of the those absconders. Besides, as of now, there is nothing available on record to establish any connection between this applicant and the vehicle carrying illicit liquor and, therefore, this applicant would be entitled to be released on bail. The application is allowed and the interim anticipatory bail granted to the applicant on 10.5.2016 by this Court is hereby confirmed on the same conditions with addition

of the condition that the applicant shall attend the police station as and when required.
